Pro-government forces seize old Gaddafi bastion Bani Walid

BANI WALID, Libya (Reuters) - Forces loyal to Libya's government took control of the former Gaddafi stronghold of Bani Walid on Wednesday, commanders said, after weeks of fighting that have underlined the weakness of central authority more than a year after Libya's revolution.

Pro-government fighters shouted "Bani Walid is free!" as pick-up trucks mounted with weapons poured into the center of the isolated hilltop town, one of the last to surrender last year to the rebels who toppled Muammar Gaddafi.

Thousands have this month fled the bloodshed between rival militias, and pockets of resistance were still reported on Wednesday on the outskirts of Bani Walid, some 170 km (105 miles) south of Tripoli.

Bent on making their mark on a town they say still harbors many of the late dictator's followers, pro-government forces fired rocket-propelled grenades and anti-aircraft weapons at empty buildings.

Heavy gunfire thundered non-stop and smoke billowed over part of the town.

The fighters cried "Allahu Akbar!" (God is Great) and "Today Bani Walid is finished!", honking car horns and blasting patriotic music from their trucks.

Some of them climbed onto the roof of one building to hoist Libya's tricolor flag and then fired their rifles in the air.

Posters of Shaban as well as historical Misrata hero Ramadan al-Swehli hung atop one town-center building. But next to it, a coffee shop stood empty with its plastic chairs still outside, and residents were notably absent from main streets.

"BANI WALID IS FREE"

"On this day - October 24 - Bani Walid is free. There are no more Gaddafi militias inside," said Fathi Shahoud, a commander of Libya Shield, a grouping of militias operating under the umbrella of the Defense Ministry. "Now we control the city and we will stay to ensure safety."

Tarek Nouri Abu-Shabi, a 21-year-old member of the Free Libya militia, said: "The revolutionaries have been in control since yesterday. These are rebels from Misrata, Tripoli and from other places. There are still small pockets of fighting on the outskirts. We found weapons inside the town."

Pro-government forces moved on Bani Walid this month after Omran Shaban, the fighter who found Gaddafi hiding in a drain in Sirte two months after rebels took Tripoli, died following two months of detention in the town.

The standoff highlighted the Tripoli government's inability to reconcile groups with long-running grievances, as well as its failure to bring many of the militias that deposed Gaddafi fully under its control.

The pro-government militias set out to find those suspected of abducting and torturing Shaban, and the national congress gave Bani Walid a deadline to hand them over.

"The military act is now finished. We now are working to make the city stable and more secure," army chief of staff Youssef al-Mangoush told reporters. "That doesn't mean that there isn't some resistance here or there. Now the government is in charge."

He said the pro-government forces had freed a number of people from detention and captured some fighters who used to belong to Gaddafi's son Khamis's brigade.

THOUSANDS FLED

According to the Libyan state news agency, the clashes in Bani Walid killed at least 22 people and injured hundreds. Thousands of families fled, saying there was no water or electricity in the city and a shortage of food and medicine.

There were unconfirmed reports on Tuesday of retribution by pro-government forces.

"The militias have entered the suburbs with bulldozers and have begun to demolish homes without reason," Abdel-Hamid Saleh, a member of a Bani Walid civil society group, said by phone.

"A woman called me yesterday screaming 'They have come for me, they have come for me' in fear. The city is falling on our heads."

The Bani Walid General Hospital was evacuated this week when, according to residents, it came under a rocket and mortar barrage.

"The patients have been moved to hiding places, homes and mosques because they were under fire in the hospital," tribal elder Mohammed al-Shetwai told Reuters.

A Reuters team was unable to reach the hospital on Wednesday because of widespread shooting.

The International Committee of the Red Cross said it had previously delivered surgical supplies to treat around 100 patients wounded by shooting inside the city, as well as other urgently needed medical supplies.

(AP) ? On the eve of their final presidential debate, Mitt Romney and Barack Obama ? through their allies ? squared off Sunday over which candidate would best protect the nation's interests and security abroad with just two weeks left in a race that polls show is increasingly tight.

Both candidates stayed largely out of view, preparing vigorously for their Monday face-off focused on foreign policy.

Republicans accused Obama of leaking word of possible negotiations with Iran in pursuit of political gain. Democrats shot back, arguing that Romney and his party are the ones playing politics with national security.

The haggling played out on Sunday news shows at a critical time for Romney and Obama, whose marathon race has become exceedingly close as it lurches toward its November conclusion. Early and absentee voting are already under way in many of the most competitive states, upping the pressure on both candidates to lock in supporters.

Two weeks out, the race appears to be tied, with both candidates taking 47 percent among likely voters in a Wall Street Journal/NBC News poll released Sunday that reflected a boost of support for Romney following his lauded performance in the first debate in early October.

Romney's top supporters launched sweeping condemnations of Obama's handling of foreign policy, assailing him over a deadly attack on the U.S. Consulate in Benghazi, Libya, and arguing that under the president's negligent watch, Iran has crept closer to obtaining a nuclear weapon.

Republican Sen. Rob Portman of Ohio, who played Obama in Romney's debate preparations, said a new report claiming the U.S. and Iran had agreed to direct negotiations seemed like "another example of a national security leak from the White House."

"They've done a lot of that," Portman said, alluding to accusations over the summer that Obama's administration was leaking information to bolster his political prospects ahead of the election. He was echoed by Sen. Lindsey Graham, R-S.C., who called the timing of the report "pretty obvious."

The White House said Saturday that while it is prepared for direct talks with Iran, there's no current agreement to meet. On Sunday, Obama's backers credited him for isolating Iran within the global community and adopting effective sanctions that have crippled the Persian Gulf nation.

"For two years, the president traveled the world putting together a withering international coalition. And now the sanctions that they agreed on are bringing the Iranian economy to its knees," said David Axelrod, a senior Obama adviser. "They're feeling the heat. And that's what the sanctions were meant to do."

Romney, taking a break from debate prep Sunday in Delray Beach, Fla., declined to answer a reporter's question about whether he would be open to one-on-one talks with Iran.

Still, Obama's allies were wedged into a defensive posture as Republicans undertook an everything-but-the-kitchen-sink approach to deflating Obama's foreign policy record. Graham said the Libya attack reflected "one of the most major breakdowns of national security in a very long time." Sen. Marco Rubio, R-Fla., in a clear nod to Cuban-American voters in his battleground state, even suggested Obama's loosening of travel restrictions to Cuba had provided a source of cash for the Castro regime and undermined political freedoms.

Democrats were ready with indictments of their own. Chicago Mayor Rahm Emanuel said the House GOP's release Friday of 166 pages of Libya-related documents had put lives in danger.

"People around the world will now know that you're at risk if you cooperate with the United States," said Emanuel, Obama's former chief of staff.

Romney's supporters waxed optimistic that the race is trending in the Republican's direction, even in crucial states like Ohio that Obama won four years ago and where unemployment is on the decline. Portman said he's traversed his home state over the past two weeks on behalf of Romney and likes what he's seeing on the ground.

"The enthusiasm energy is on our side this year. I mean, it's not like 2008 at all," he said.

Both candidates dedicated their weekend to intensive study for the debate; Obama huddled with advisers in Maryland and Romney with his team in Florida.

On the agenda were Iran-Israel tensions, China, terrorism and the war in Afghanistan ? all subjects expected to come up Monday in the 90-minute encounter moderated by CBS News' Bob Schieffer. Although polls show the economy is of top concern to most voters, global affairs have cropped up as a key issue in the final weeks due to unrest in Libya, Syria and elsewhere.

Romney paused his preparations to attend church with his wife Sunday morning and to watch his traveling press corps play touch football against his senior staff. The former Massachusetts governor presided over a coin toss on the beach, then gathered his aides to cheer them on.

"That's right, don't worry about injuries guys, this counts. Win," he joked.

Romney didn't talk politics, refusing to answer a question about whether, if elected, he would be open to direct talks with Iran. Questions from reporters about the new poll and Monday's debate likewise went unanswered.

How do I Begin Estate Planning? An Interview with John O'Grady ...

Dana: I?ve been told that possessions are one of the least taboo topics to bring up regarding the death conversation. Do you find that people have an easier time talking about estate planning, versus, for example, what kind of death they want to have, or their funeral, etc?

John: Yes. Death is an emotional issue. The skill in my work is the art of looking at their denial. There are many ways to do that. Talking about possessions is one of them. Another angle on it is when people are talking to their parents about doing a will and a trust, the parents don?t like that idea and think the kids are being greedy. But the kids just want it to be clear and simple. Often without a trust it has to go through the court system, but good planning can make life easier for the kids [after their parents' passing].

Dana: Do you think that?s because they don?t want to talk about death?

That?s part of it, and also often this is the first time in their lives that they?re talking about money. Also, older people are very sensitive about discrimination and agism, and they don?t want to be written off as ?dead.? And often signing a will is equated with being dead.

Denial is the name of the game. To sign a will and trust, you need to face the trauma of your own dying. It?s on everyone?s ?to-do list,? but at the very bottom until there?s a crisis. People will call me before flying to Europe, for example. There?s an irrational fear that flying is dangerous.

Dana: So they want to have their ?affairs in order??

John: Yes. And there are a couple of other crises that make them think about it. One is a terminal diagnosis. Even with that, though, we?ll have people that wait until the last minute. They even procrastinate then! They have a hard time facing the fact that they?re going to die.

The other one is someone close to them dying, and it gets them thinking about their own death. But nobody is planning to die this year, so the vast majority of people just put it off indefinitely, which means that most of my work is cleaning up disasters that could have been avoided with a little planning.

Dana: What do you recommend to people to get that conversation started and make it easier?

John: Everybody?s busy, and they have a long story for why they can?t get started. So I say, ?What could be more important than taking care of yourself and your loved ones with estate planning??

Dana: So, impressing the importance of it on them, or explaining the disasters that you face if it isn?t taken care of?

John: Well, not really. It?s not me telling them what to do, because then they?ll be defensive. I get them talking about it themselves and why they think their other affairs are more important than estate planning. It?s not a rational thing. If it was a rational thing, everybody would have an updated estate plan.

The reality is that less than ten percent of American adults have an up-to-date estate plan.

Dana: Can you talk about the emotional issues that arise with estate planning?

John: There?s lots of sibling rivalry, and rivalry with a new spouse, things like that. I provide a structured counsel to my clients. There are several repetitive family dramas that re-occur. A lot are replays of old Greek classic tragedy.

There?s the Cinderella theme ? stepchild in conflict with the stepmother. There?s Shakespeare?s King Lear, where the king tries to get the kids to fight with each other to determine who?s worthy of being the king. There?s the caregiver kid and the untrustworthy trustee.

Dana: The Caregiver Kid?

John: Typically, this is a woman, because women tend to be more concerned about caregiving. Sometimes the caregiver kid gets access to all the money and is receiving gifts the other kids aren?t giving.

Dana: Kind of a favoritism thing?

John: Yes.

John: Mainly, do something. Because these are really big decisions. Part of the paralysis is that these are such big decisions, and people want to put them off. I tell them, these won?t be perfect decisions, and you can change your mind as long as you?re alive, so you might as well make some kind of decision now. After you sign the documents you?ll get more information about whether that?s what you really want. But you have to start somewhere, so do something.

The first step is to always call a lawyer. Make an appointment with the lawyer and get it on the calendar. Otherwise, it?s just an abstract idea. When it?s an appointment on your calendar, you have to show up for it. It?s off your to-do list and on your calendar.

I always remind clients that it doesn?t cost anything to make the appointment, so cost doesn?t have to be a barrier to taking that first step.

Dana: How early do you recommend starting this planning?

John: Actually, young people should have an advanced healthcare directive ? they?re the ones taking all kinds of risks, riding motorcycles, jumping off of cliffs. The reality is that most people who have them are over sixty and not taking risks anymore. I recommend young adults have a will and an advanced healthcare directive. In California, they should have a trust if non-retirement assets are worth $150,000 or more, and every jurisdiction has slightly different laws. Some also have different names for the documents (some call an advanced healthcare directive a ?living will.?)

Dana: Is the planning usually more or less complicated than people are anticipating?

John: It?s hard to say. You never know what?s going to happen in the process, how the family conversation will go, what the lawyer will ask, how the spouses will react. People want to know the cost [of the whole process] in the first phone call, and I can never really tell them. How much it costs is up to them. In the initial phone call, I explain the process to them in great detail, and what the major questions are [throughout the process].

Dana: Can you name some of those questions?

John: Who will be the executor or trustee (in charge of the money)? Who?s going to decide that the day has come that I?m incapacitated? Who?s going to get what?

Stronger dollar hurts McDonald's 3Q results

NEW YORK (AP) ? Tough competition in the U.S. and the weakening economy abroad was a double whammy for McDonald's in the third-quarter, sending the burger chain's net income down nearly 4 percent.

McDonald's said it was adjusting some of its plans to deal with the pressures, including stepping up advertising for its dollar menu and bringing back the popular McRib sandwich nationally in December to drive traffic into U.S. stores.

The world's largest hamburger chain with 33,000 locations worldwide has thrived in boom and bust times by selling cheap eats and constantly updating its menu. But global economic pressures and intensifying competition are wearing at the company, which does two-thirds of its business overseas.

"When economic crisis began in 2008, few people thought the environment would still be as uncertain and fragile as it is today," said CEO Don Thompson in a call with analysts. "It is clear however that this operating environment is the new normal. As such our near-term focus is on stabilizing and growing traffic and market share."

Thompson said revenue in stores open at least 13 months, a key restaurant metric, is trending negative so far in October.

That news sent shares down $4.14, or 4.5 percent, to close at $88.72 Friday. The stock had been down 7 percent since the beginning of the year.

"McDonald's is facing a lot of pressure," said Morningstar analyst R.J. Hottovy. "They're seeing more competition from their quick-service restaurants and fast-casual peers in the U.S. and facing austerity measures and macro-economic pressures in Europe and Asia"

Oak Brook, Ill.-based McDonald's said Friday its net income fell to $1.46 billion, or $1.43 per share. That compares with net income of $1.51 billion, or $1.45 per share last year. Analysts expected net income of $1.47 per share, according to Fact Set.

The stronger dollar hurt net income by 8 cents per share. When the dollar is strong, international sales translate into fewer dollars back at home.

Revenue was nearly flat at $7.15 billion from $7.17 billion last year. Analysts expected revenue of $7.17 billion.

Revenue in stores open at least 13 months rose 1.9 percent globally, including a 1.2 percent rise in the U.S., where the company said it faced "broad competitive activity."

McDonald's is facing stiffer competition from newer chains like Panera Bread Co., which offers higher-end food in a fast casual atmosphere. Long-time rivals such as Wendy's Inc. and Burger King Worldwide Inc. are also reworking their menus, renovating restaurants and launching new ad campaigns to win back customers.

McDonald's said it will step up advertising around its dollar menu rather than its more profitable extra value menu that includes items more expensive than $1. Fast-food chains usually lose money on dollar menus, but they're used as a traffic driver in the hopes customers will spend more once they're at McDonald's. It's also bringing back the always-popular McRib sandwich in December and introducing a new item, a cheddar bacon onion sandwich that will be available in both chicken and beef varieties.

Hottovy, the Morningstar analyst, said focusing on the value menu was a good move for McDonald's: "In this environment you have to give customers what they want, and across the globe consumers are squarely focused on value."

In Europe, where McDonald's does 40 percent of its business, revenue in stores open at least 13 months rose 1.8 percent, hurt by negative guest traffic.

In Asia/Pacific, the Middle East and Africa, the measure rose 1.4 percent as the company promoted limited-time offers and traffic increased. In China, the measure rose 3.6 percent. Many U.S. companies are focusing on China for growth, but there is concern of a slowdown in the country. But Thompson said the country is a "market with significant potential," and that McDonald's is on track to open 225 to 250 restaurants there this year, with the goal of having 2000 open by the end of 2013.

Janney Capital Markets analyst Mark Kalinowski said he expects tougher comparisons with a year ago will weigh on sales trends and lowered his estimates on McDonald's for the current fiscal year as well as fiscal 2013 and 2014. He kept his "Neutral" rating on the stock.

"We would not be buyers in the context of tougher year-over-year comparisons in the U.S. to be lapped over October through May," he wrote in a client note.
